Yes, your spouse will have to sign documents (digitally via email is an option). So you’ll need to be in touch with them & have them agree to the terms. Without their signature, your divorce will not get finalized.
What if we don't live in Utah?
Good news! You are NOT required to live or reside in Utah. Recent changes in Utah law allow non-resident couples to file for divorce in Utah if both spouses signed an affidavit consenting to Utah’s personal jurisdiction for divorce or annulment. Since all Utah County-issued online marriage licenses require this affidavit, you and your partner should have already completed it.

- Effective September 1, 2024, Utah Code § 81-4-402(1)(c) confirms that couples who have consented to personal jurisdiction are eligible to file for divorce in Utah, even if neither party resides in the state (read code here).
