FAQ

Will my spouse need to be involved?

Yes, your spouse will have to sign documents (digitally via email is an option). So you’ll need to be in touch with them & have them agree to the terms. Without their signature, your divorce will not get finalized.

What if we don't live in Utah?

Good news! You are NOT required to live or reside in Utah. Recent changes in Utah law allow non-resident couples to file for divorce in Utah if both spouses signed an affidavit consenting to Utah’s personal jurisdiction for divorce or annulment. Since all Utah County-issued online marriage licenses require this affidavit, you and your partner should have already completed it.

  • Effective September 1, 2024, Utah Code § 81-4-402(1)(c) confirms that couples who have consented to personal jurisdiction are eligible to file for divorce in Utah, even if neither party resides in the state (read code here).
What if we're long distance?

Good news! You do NOT need to be living together.

You & your spouse will simply sign the documents electronically. So you do not need to be living together. It’s perfect for long distance couples & even works if you both live outside the USA.

Could we get an Annulment instead of Divorce?

Divorce is easier & doesn’t require specific reasons.

Utah has limited conditions for Annulments. In Utah, you could only file an Annulment under specific scenarios. Examples are 1) one of you was married to someone else at time of your wedding. 2) one of you was under 18 years old at time of marriage 3) You are close relatives (siblings or cousins). How quickly can I get divorced?

Timing will depend on the timeline of the judge & commissioner assigned to the case. While we can’t guarantee a specific time range, most couples can estimate 60 to 90 days to receive a divorce decree.

Are my divorce records private?

Yes, divorce records (petitions for divorce) in Utah are private.

Only certain people can see divorce records, like:

  • the people getting divorced
  • their lawyers
What is an accepted "Grounds for Divorce"?

When filing for divorce, you need to give the court a reason.

For example, one reason is that you and your spouse have serious marital problems that cannot be fixed. This is called “irreconcilable differences”.

What are the government fees?

In addition to the pricing above, you’ll pay government fees directly to the government of Utah. The government of Utah has fees for court filings:

Note: if you can prove low-income, you can petition the court to waive the fees.

What if we're not in agreement?

Best if you have an agreement on joint filings & can get your spouse to sign documents digitally (via email).
